The Spouse Visa (Subclass 309) is a temporary visa that leads to a permanent partner visa Subclass 100. This visa lets the de facto partner or spouse of an Australian citizen, Australian permanent resident, or eligible citizen of New Zealand to live in Australia temporarily.

Eligibility Requirements
To be eligible for the Spouse Visa (Subclass 309) visa, you must:
- not have a cancelled visa or refused application
- not hold particular regional visas
- be outside of Australia when you apply for this visa
- be in a genuine relationship with your spouse or de facto partner who is an Australian citizen, Australian permanent resident, or eligible New Zealand citizen
- have an eligible sponsor who is not barred to sponsor you.
- meet the health and character requirements set by DHA
- not have any debt to the Australian government
To be eligible for the New Zealand stream, you must:
- Hold a New Zealand Special Category (Subclass 444) visa
- Have lived in Australia for the past 5 years or more
- Demonstrate skills desirable to the Australian job market
To be eligible for the Hong Kong or British National stream, you must:
- Hold a Hong Kong or British National (Overseas) passport
- Meet a variety of visa requirements
- Meet a variety of residency requirements.
Application Process
Application Process
In order to apply for the Spouse Visa (Subclass 309), you will need to:
- lodge a combined application for Spouse Visa (Subclass 309) online from outside Australia
- provide documents such as marriage certificate or Relationship Registration Certificate if you were married overseas. Your marriage should be recognised in Australia
You may be required to supply further supporting documents for assessment by the Department of Home Affairs (DHA).
