More Than Just a Café, A Dream Finally Recognised

The Dream

A growing restaurant business in Sydney had built a strong neighbourhood following. With seating for
around 50 guests, a curated menu prepared from fresh ingredients and a focus on table service and
ambience, the restaurant aimed to provide more than just a quick meal. It offered a complete dining
experience.
The business nominated a Café or Restaurant Manager under ANZSCO 141111 through the Subclass
482 visa in the Short-term stream. The role was central to overseeing operations, supervising staff,
maintaining quality, managing customer experience and supporting future expansion plans, including the
introduction of a full dinner service.

The Problem

The nomination was refused. The Department concluded that the business fell within the definition of a
“limited service restaurant” under caveat 8 of the relevant legislative instrument. If classified as a limited-
service restaurant, the nominated occupation of Café or Restaurant Manager would not apply.
The delegate was not satisfied that sufficient evidence had been provided to demonstrate that the
restaurant was not limited in its service offering. The menu was viewed as relatively simple, and the
operational model was questioned.
The refusal placed the business in uncertainty. The nominated role was integral to maintaining standards,
managing staff and delivering a full-service dining experience. Yet the nature of the restaurant itself was
misunderstood.

The Solution

The matter was taken to the Tribunal. Updated evidence was provided, including operational documents,
financial records, sample invoices, daily reports, photographs of the premises, employee lists and
detailed submissions about how the restaurant operated.
The Tribunal considered evidence that the restaurant provided table service, accepted reservations,
offered seasonal menu changes and daily specials and prepared dishes from scratch in a fully equipped
commercial kitchen. The menu included items such as risotto, steak dishes and specialty sandwiches
prepared to order from fresh ingredients.
The Tribunal found that the restaurant’s characteristics went well beyond those of a fast food, takeaway,
or limited-service café. It accepted that the business delivered a complete dining experience consistent
with a full-service restaurant.

The Victory

The Tribunal was satisfied that the nominated occupation of Café or Restaurant Manager applied to the
position and that the requirements were met. It set aside the refusal and remitted the nomination for
reconsideration with the order that the criterion was satisfied.
