The Dream
A young student from Colombia arrived in Australia in 2019 with a clear goal: to learn English and build a future. Over the years, he successfully completed multiple language courses and integrated into the Australian community. He even took steps to move toward a skilled work visa to contribute his skills to the local workforce.
The Problem
His journey hit a major roadblock when he struggled to maintain his enrolment in a full-time course. Due to various challenges, including waiting for a new work visa to be processed, he was not enrolled in a course for over 14 months. As a result, the Department cancelled his student visa, stating he was no longer meeting the primary purpose of his stay.
The Solution
The case was taken to the Tribunal. The review looked beyond the technical breach of visa conditions. Evidence showed that the student had a genuine history of study and was actively working toward a lawful permanent pathway through a skilled visa nomination. It was argued that cancelling the visa would be too harsh given his efforts to comply and his pending work visa application.
The Victory
The Tribunal agreed that while a breach had occurred, cancellation was not the right outcome. It found that the student had genuine reasons for his situation and was committed to his future in Australia. The Tribunal set aside the cancellation, allowing him to stay and continue his journey toward a skilled career.
