A Business Built on Trust, A Role Finally Acknowledged

The Dream

For more than two decades, a well-established retail business had served its community across multiple
locations in Australia. With physical stores and a strong online presence, the business supplied a wide
range of books, educational resources, clothing, and lifestyle products. Behind the scenes, managing
stock levels, negotiating with suppliers and anticipating customer demand required experience and
commercial judgment.
To support its continued growth, the business nominated a Retail Buyer under the Subclass 482 visa in
the Short-term stream. The role was central to procurement, pricing strategy, inventory control and
supplier relationships. The aim was continuity. The business needed a dedicated professional to oversee
buying decisions and ensure products remained aligned with customer demand.

The Problem

The nomination was refused. The Department was not satisfied that the position of Retail Buyer was
genuine under regulation. Despite evidence of multi-state operations, substantial annual turnover
exceeding $1.6 million and an established organisational structure, the genuineness of the role was
questioned.
The refusal placed the business in uncertainty. Without an approved nomination, its procurement and
merchandising functions faced disruption. The position was not theoretical. It was embedded in daily
operations, directly influencing sales performance, inventory management, and supplier negotiations.

The Solution

The matter was taken to the Tribunal. A comprehensive submission was provided, including company
extracts, tax returns, business activity statements, financial statements, organisational charts,
employment contracts and PAYG records.
Detailed evidence demonstrated that the Retail Buyer monitored sales data and stock levels, negotiated
purchase and supply arrangements, implemented pricing and promotional strategies, anticipated
consumer trends and ensured product quality. The Tribunal compared the duties of the role with ANZSCO
639211 Retail Buyer and found substantial alignment.
The evidence showed the role was not created for migration purposes. It was integral to the scale and
complexity of the business operations.

The Victory

The Tribunal was satisfied that the position associated with the occupation was genuine and full-time. It
set aside the refusal and remitted the nomination for reconsideration, confirming that the requirements of
sub regulation were met.
Their Words
“We knew the role was essential to how our business operates. The Tribunal looked at the full picture and
recognised that.”
